1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the Pokope platform operated by PT Pokope Solusi Edukasi ("Pokope", "PSE", "we", "us"). By creating an account or using our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our platform. These Terms are governed by the laws of the Republic of Indonesia.

2. Definitions

  • "Platform" — The Pokope website, mobile applications, and related services
  • "User" — Any individual who creates an account on the Platform
  • "Card" — Any collectible trading card (e.g., Pokémon, One Piece) listed on the Platform
  • "Vault" — Pokope's secure physical storage facility for Cards
  • "Holding" — A User's ownership record of a Card stored in the Vault
  • "Rider" — An authorized Pokope field sales representative
  • "IDR" — Indonesian Rupiah, the primary currency of the Platform

3. Eligibility

To use the Platform, you must:

  • Be at least 17 years of age (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using the Platform under applicable laws
  • Provide accurate and complete registration information

Users under 17 may use the Platform only with verifiable parental or guardian consent.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Pokope is not liable for losses arising from unauthorized account access where you have failed to safeguard your credentials.

One person may maintain only one account. Multiple accounts may be suspended or terminated.

5. Card Purchases and Ownership

5.1 Purchasing

When you purchase a Card through the Platform, you acquire full ownership of the physical Card. All prices are displayed in IDR and include applicable taxes unless stated otherwise. Payment is processed through our authorized payment processor (Midtrans).

5.2 Vault Custody

After purchase, Cards are stored in the Pokope Vault on your behalf. Pokope acts as a custodian, not an owner, of your Cards. You retain full ownership rights. Pokope will exercise reasonable care in storing and protecting your Cards but is not an insurer unless you have purchased Card Insurance (see Section 9).

5.3 Valuation

Card valuations displayed on the Platform are estimates based on market data and Pokope's assessment. These are not guaranteed prices. The "Market Estimate" and "PSE Exit Now" prices are different values and serve different purposes:

  • Market Estimate: An indicative market value based on comparable sales
  • PSE Exit Now: The price at which Pokope is willing to buy back the Card

6. Delivery

You may request physical delivery of Cards you fully own. Delivery is available only for whole-owned Cards (fractional ownership, if ever introduced, does not qualify for delivery unless fully bought out).

Delivery fees, shipping method, and estimated timeframes will be displayed before you confirm. Risk of loss transfers to you upon handover to the courier service. Pokope is not responsible for delays, damage, or loss caused by the courier.

7. Buyback and Selling

You may request a buyback quote from Pokope for Cards in your Vault. Pokope is under no obligation to provide a quote or to purchase your Card. Quotes are valid for a limited time and expire automatically. Expired quotes cannot be accepted.

Once you accept a quote, the transaction is binding. Pokope will process the payment to your designated bank account, subject to admin approval and anti-fraud review.

8. Payouts

All payouts require admin approval. There is no automatic payout release path. Payouts are processed to the bank account registered in your profile. Processing times may vary; Pokope aims to complete approved payouts within 3-5 business days.

Pokope reserves the right to withhold payouts pending investigation of suspicious activity, fraud, or regulatory compliance requirements.

9. Card Insurance

Pokope offers optional Card Insurance for Cards stored in the Vault. Insurance is a monthly subscription priced as a percentage of the Card's current value.

  • Basic Coverage: Covers physical damage to the Card while in Vault custody
  • Premium Coverage: Covers physical damage, loss, and theft

Insurance claims are subject to review and approval by Pokope. Filing a fraudulent claim is grounds for account termination and may result in legal action. Insurance does not cover Cards in transit (delivery) or Cards no longer in Vault custody.

10. Gacha / Capsule Machine

The Pokope Gacha Capsule Machine is an entertainment feature that uses Spin Tokens (not real currency) to award randomized prizes. Prizes may include Cards, coins, experience points, or other in-platform rewards.

Gacha outcomes are determined by a random number generator with published probability rates. Pokope does not guarantee any specific outcome. Spin Tokens have no cash value and are non-refundable.

11. Auction House

Users may list Cards for auction through the Pokope Auction House. By placing a bid, you commit to purchasing the Card at your bid price if you are the winning bidder. Pokope charges a platform fee on completed auction transactions. All auction sales are final.

12. Rider / Field Commerce

Pokope operates mobile card shops through authorized Riders. Purchases from Riders are subject to the same terms as online purchases. Riders are authorized representatives of Pokope and are bound by Pokope's operational policies.

13. Prohibited Conduct

You agree not to:

  • Use the Platform for money laundering, fraud, or illegal activities
  • Create multiple accounts to circumvent limits or restrictions
  • Manipulate Card valuations, auction prices, or platform mechanics
  • Submit fraudulent insurance claims or payout requests
  • Reverse engineer, scrape, or interfere with the Platform's operation
  • Impersonate other users or Pokope staff
  • Use automated tools (bots) to interact with the Platform without authorization

14. Intellectual Property

The Pokope platform, including its design, code, logos, and content, is owned by PT Pokope Solusi Edukasi. Card images and franchise names (Pokémon, One Piece, etc.) are trademarks of their respective owners. Pokope does not claim ownership of these marks.

15. Limitation of Liability

To the maximum extent permitted by Indonesian law:

  • Pokope's total liability for any claim shall not exceed the amount you paid to Pokope in the 12 months preceding the claim
  • Pokope is not liable for indirect, incidental, special, or consequential damages
  • Pokope is not liable for fluctuations in Card values or market conditions
  • Pokope is not liable for losses caused by third-party services (payment processors, couriers, grading services)

Nothing in these Terms excludes liability for fraud, willful misconduct, or liability that cannot be excluded under applicable law.

16. Indemnification

You agree to indemnify and hold harmless Pokope, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

17. Dispute Resolution

Any dispute arising from these Terms shall be resolved through:

  1. Negotiation: Good faith negotiation between the parties for 30 days
  2. Mediation: If negotiation fails, mediation through an agreed mediator
  3. Arbitration: If mediation fails, binding arbitration under the rules of the Indonesian National Board of Arbitration (BANI) in Jakarta

For users in the EU/EEA, you retain the right to bring proceedings in your local courts as provided by applicable consumer protection laws.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles. For EU/EEA users, mandatory consumer protection laws of your country of residence also apply.

19. Modifications

Pokope reserves the right to modify these Terms at any time. Material changes will be communicated at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
